What Georgia Law Covers

Georgia prosecutes child pornography primarily under O.C.G.A. § 16-12-100, the sexual exploitation of children statute. It prohibits knowingly possessing, controlling, creating, reproducing, publishing, promoting, selling, distributing, or exhibiting any material depicting a minor under 18 engaged in sexually explicit conduct. That includes photographs, videos, digital files, and electronically stored data that can be converted into a visual image.

A separate statute, O.C.G.A. § 16-12-100.2, the Computer or Electronic Pornography and Child Exploitation Prevention Act, covers the use of online services, chat rooms, and electronic devices to solicit or exploit minors. Charges may be filed in Douglas County Superior Court when the alleged conduct is confined to Georgia, or in the U.S. District Court for the Northern District of Georgia when interstate file transmission, peer-to-peer networks crossing state lines, or federal agencies such as the FBI or Homeland Security Investigations are involved.

Penalties & Collateral Consequences

Under Georgia law, possession of child pornography is a felony. A single count carries 5 to 20 years in prison and fines up to $100,000. Production or distribution carries the same range with a mandatory minimum of 5 years, and courts can impose consecutive sentences across counts. Those previously convicted of a qualifying sexual felony who are convicted again face dramatically harsher consequences, up to and including life imprisonment. Federal charges under 18 U.S.C. § 2252 or § 2252A impose their own mandatory minimums for distribution and receipt, with sentencing guidelines that leave judges far less discretion than state proceedings allow.

Every conviction, state or federal, requires mandatory registration on the Georgia sex offender registry under O.C.G.A. § 42-1-12. Registered sex offenders can’t live or work within 1,000 feet of schools, churches, child care facilities, parks, playgrounds, or school bus stops.   • Deleted files: Files aren’t fully removed when deleted and can be recovered using tools like EnCase. Proving the defendant knowingly possessed recovered files requires more than showing they once existed on the device.
  • Mistaken identity: When multiple people share a device, network, or account, attributing specific files to one individual requires the prosecution to prove more than shared access.
  • Entrapment: When undercover law enforcement induced conduct the defendant wouldn’t otherwise have taken, an entrapment defense may apply.
  • Chain of custody: Any break in how digital evidence was handled, stored, or transferred from seizure through forensic analysis can compromise the prosecution’s case.
