The Criminal Case & Administrative Driving Proceedings
The criminal DUI case and administrative license process are separate proceedings. The criminal case addresses the charge in court, while the administrative process concerns driving privileges. Action in one proceeding doesn’t automatically resolve the other.
When an administrative suspension applies, the arresting officer takes the driver’s license and issues a 45-day temporary driving permit. A driver generally has 30 days from personal notice or notice by certified mail to request an administrative license suspension hearing, commonly called an ALS hearing, and pay the $150 filing fee. Missing that deadline waives the hearing.
A driver accused of refusing chemical testing may elect a one-year ignition interlock limited permit within the same 30-day window. The permit restricts driving to a vehicle equipped with an approved device. Whether this option fits a particular situation requires reviewing the notice, alleged refusal, and license history.
How We Evaluate a Douglasville DUI Charge
We review case documents, police reports, and available test results. We examine whether officers followed constitutional requirements during the traffic stop and arrest. We also assess roadside procedures, including field sobriety and chemical testing when either forms part of the evidence.
Depending on the allegations and disputed issues, a DUI case may proceed through arraignment, motion hearings, and trial. At arraignment, the accused is formally advised of the charge and enters a plea. We communicate regularly throughout each applicable stage so clients know what’s happening and what requires their attention.
